This Quorum Privacy Policy (this “Privacy Policy”)
describes the data protection practices of Quorum Research LLC (“Quorum,”
“we,” “us,” or “our”) with respect to all websites and
services operated by us that link to this Privacy Policy, including, without
limitation, quorumapp.com, and all related online services offered by us
(collectively, the “Quorum Platform”). Capitalized terms used but not
defined herein have the meanings given to such terms in the Terms of Use.
This Privacy Policy (together with our Terms and Conditions
and any other documents referenced therein or herein) describes the personal
data we may receive or collect from you, and how that information may be used
or disclosed by us. This Privacy Policy also describes the choices
available to you regarding the use of, your access to, and how to update and
correct your personal information. This Privacy Policy does not apply to
information that we may collect through any other means, or to information
collected on any other company, affiliate, or third-party site, or by any
third-party application that may link to or be accessible from the Quorum
Platform.
PLEASE READ THIS PRIVACY POLICY CAREFULLY. BY ACCESSING OR USING THE QUORUM PLATFORM, YOU AGREE TO OUR USE OF YOUR INFORMATION AS DESCRIBED HEREIN. YOUR ACCESS TO AND USE OF THE QUORUM PLATFORM IS SUBJECT TO THIS PRIVACY POLICY AND OUR TERMS AND CONDITIONS.
We collect several types of information from and about users
of the Quorum Platform, including:
Quorum may conduct short surveys for screening purposes, or ask custom screening questions if a Researcher
has asked us to screen for Participants meeting specific requirements. Your
responses to those screening surveys will be saved to your profile and will
therefore form part of your profile data. Like the rest of your profile data,
your responses will be used for demographic screening to establish your
eligibility for Studies. You can remove your responses from your profile at any
time. Quorum may also conduct Studies using the Quorum Platform as a
Researcher. We may process information submitted by you in connection with these
Studies (“Quorum Study Data”), which could be wide-ranging and might overlap
with the subject matter of your profile data. The Quorum Study Data could also
include special categories of data.
We use information that we collect about you or that you
provide to us, including any personal data, in the following ways:

provide you with the use of the Quorum Platform, communicate with you in
relation to your use of the Quorum Platform, to perform our obligations and
exercise our rights under the Terms and Conditions, and to prevent security
breaches or fraud.

To
screen demographic information to ensure your participation in suitable Studies
through automated decision-making
·
To
analyze performance and data quality and to prevent fraud through automated decision-making
·
To
send you promotional content related to the Quorum Platform if you have not
opted out of marketing communications, deliver ads, and make recommendations
through your social media profiles.

To
request feedback on the Quorum Platform or conduct market research in relation
to the Quorum Platform.
·
To
verify your identity for fraud prevention purposes and keep a record of the
checks we have conducted.
·
To
resolve disputes between our users or to investigate suspected misuse of the
Quorum Platform.
·
To
improve our products and services, including the Quorum Platform, and to analyze
testing results.
·
To
keep records relating to your use of the Quorum Platform on the bases of
compliance with law and conduct of business, and in connection with legal
claims.
·
To
host, backup and restore our IT systems or databases.
·
To
protect the vital interests of any individual.
·
As
otherwise permitted under this Privacy Policy or as otherwise authorized by
you.
Notwithstanding the foregoing, we may use information that
does not identify you (including information that has been de-identified)
without obligation to you except as prohibited by applicable law.
Notice to EU
Residents
If you are located in the European Economic Area (“EEA”),
you may have additional rights under the EU General Data Protection Regulation
(the “GDPR”). This section applies only to individuals located in the
EEA. It describes how we may collect, use and share
Personal Data of EU residents in operating our business, and EU residents’
rights with respect to that Personal Data.
For purposes of
this section, “Personal Data” has the meaning given to it in the GDPR but does
not include Information exempted from the scope of the GDPR. Quorum is the
controller of your Information in connection with services provided through the
Quorum Platform.
The “Types of
Data We Collect” section above details the Personal Data we collect from and
about you. The “How We Use Collected Information” section above explains how we
use your Personal Data. We will only process your Personal Data if we have a
valid legal reason for doing so, including your consent, contractual necessity,
and our “legitimate interests” or the legitimate interests of others.
You have the
right to request access to your Personal Data, to have your Personal Data
corrected, restricted or deleted, and to object to our
processing of your Personal Data. You also have the right of data portability,
which means that you can request that we provide you (or a third party you
designate) with a transferable copy of Personal Data that you have provided to
us. Your rights may be subject to various limitations under the GDPR. If you
wish to exercise any of these rights, or if you have concerns about our
processing of your Personal Data, please contact us in any of the ways listed
in the section “Contact Us” below. We reserve the right to confirm your EU
address and will need to confirm your identity to process your request.
By using the
Quorum Platform, you acknowledge that any Personal Data about you is being
provided to Quorum in the United States and you authorize us to transfer, store
and process your Personal Data to and in United States and elsewhere.
We or our third-party
designees may use cookies and similar tools to analyze use of the Quorum
Platform and deliver features of the Quorum Platform, to help us understand how
users engage with the Quorum Platform, and to improve your experience. Such
features may appear on the Quorum Platform, or on other websites or services.
We use these technologies in order to offer you a more
tailored experience in the future.

cookie is a small text file that is placed on your computer or mobile device
when you use the Quorum Platform, that enables us to: (i) recognize your computer; (ii) store your preferences and
settings; (iii) understand the web pages of the Quorum Platform you have visited; (iv) enhance your user experience by
delivering and measuring the effectiveness of content and advertising tailored
to your interests; (v) perform searches and analytics; and (vi) assist with
security and administrative functions. Some cookies are placed in your browser
cache while those associated with Flash technologies are stored with your Adobe
Flash Player files.

Tracking
pixels (sometimes referred to as web beacons or clear GIFs) are tiny electronic
tags with a unique identifier embedded in websites, online ads and/or email
that are designed to: (i) collect usage information
like ad impressions or clicks and email open rates; (ii) measure popularity of
the Quorum Platform and associated advertising;
and (iii) access user cookies.
You can learn more about opting out of analytics from our
third-party providers by visiting their respective opt out pages and the
Digital Advertising Alliance. Please note that using these opt out options does
not mean that you will not receive advertising while using the Quorum
Platform or while you are browsing the
web. We are not responsible for maintaining these opt out choices or for the
advertising activities of third parties.
Please note that you can change your settings to notify you
when a cookie is being set or updated, or to block cookies altogether. Please
consult the “Help” section of your browser for more information (e.g., Internet
Explorer; Google Chrome; Mozilla Firefox; or Apple Safari). Please note that by blocking, disabling, or
managing any or all cookies, you may not have access to certain features or
offerings of the Quorum Platform.
Do Not Track (“DNT”) is a privacy preference that
users can set in certain web browsers. We are committed to providing you with
meaningful choices about the information collected on the Quorum
Platform, and that is why we provide
the variety of opt-out mechanisms listed above. However, we do not currently
recognize or respond to browser-initiated DNT signals.
Information Accessible to Researchers on the Quorum Platform
We will only disclose any personal identifiers to
Researchers (such as your name, contact details, email address or social media
accounts) if you agree to share this information with Researchers in their
study terms. The data available to Researchers will be exported by reference to
your Quorum ID rather than to any personal identifiers unless you agree to
share personally identifiable information in the Researcher’s study terms.
By registering for the Quorum Platform, you are adding
yourself to a pool of prospective study participants that Researchers are
entitled to view. After you have registered for the Quorum Platform, even
before you register for a Researcher’s study, Researchers may be able to see
profile information (such as demographic data) relating to Participants for
screening purposes. They will also see performance data connected with your
completion of the Study. Any direct identifiers in the profile information
or performance data (such as your name, email address or contact information)
will NOT be available to Researchers prior to your acceptance of their study
terms. If you decide to participate in a Study:
When you participate in Studies, you may provide further
information directly to the Researcher. Because Studies can take place outside
the Quorum Platform, we may not see your Study responses. Researchers should
accompany each Study with an appropriate privacy notice and/or consent form to
give you information about how the Researcher will use your responses, but we
are not responsible if they do not.
We record your IP address whenever you make a Study
submission, which we may use to help the relevant Researcher to pay you for
that Study submission. If the Researcher has not correctly received your Quorum
ID for any reason in connection with a Study submission, we can match the IP
address to the missing Quorum ID, allowing the Researcher to pay the Reward
associated with that Study submission.
While we make an effort to obligate
Researchers to comply with applicable data protection law in conducting their
Studies, we are not responsible for their actions.
Some data you can delete
whenever you like, some data we will delete upon request, some data is deleted
by our application automatically, and some data we retain for longer periods of
time when necessary. This section describes
different types of data we may retain.
We may disclose your personal data to our suppliers or
contractors in connection with the uses described above. We may disclose
verification data, any personal data in our possession which host the servers that
store our data, and transaction and payments information to our payment
services, [Stripe]. We will share transaction and payments data with these
providers only to the extent necessary for the purposes of processing payments,
refunding payments, and dealing with complaints and queries relating to payments
and refunds. We may also disclose usage data and account data for the purposes
of analyzing the use of the Quorum Platform, account verification and for fraud
prevention. Usage data may also be processed by third party providers who
deliver ads.
If you access or use our
services outside of the United States, please be aware that your personal
information may be transferred to, processed, maintained, and used on
computers, servers, and systems located outside of your state, province,
country, or other governmental jurisdiction where the privacy laws may not be
as protective as those in your jurisdiction. If you are located outside the
United States and choose to use the Quorum Platform, you hereby irrevocably and
unconditionally consent to such transfer, processing, and use in the United
States and elsewhere.
This Privacy Policy applies only to the Quorum Platform,
which may at times link to third-party websites (such as third-party survey
platforms or social media operators) that are not owned or controlled by us.
These third-party websites may have separate and independent privacy policies
and terms of use, and we encourage you to review their privacy notices and
relevant terms to understand the uses they might make of your personal data.
You understand, acknowledge and agree that Quorum
shall have no responsibility or liability for the content and activities or
your use of any linked websites, and that you click on a link to a third-party
website at your own risk. Furthermore, we require Researchers to comply with
applicable data protection law in conducting their Studies, but we are not
responsible for their actions.
We cooperate with government and law enforcement officials
and private parties to enforce and comply with the law. We may, without
providing notice to you, disclose any personal data to government or law
enforcement officials or private parties:

where
we are required to do so by law, including, but not limited to, in response to
a court order or subpoena; or
·
in
response to a request by a government or law enforcement agency or if we
believe such disclosure may prevent or mitigate the threat of crime or harm to
our users or others, facilitate an investigation related to a user’s safety or
public safety, protect the security or integrity of our services, or enable us
to take precautions against liability.
We may disclose your personal data in connection with legal
claims. We may disclose your personal data to our legal or professional
advisors (under obligations of confidentiality) for the purposes of taking
advice. We may disclose your personal data to a buyer in the event of a merger,
divestiture, restructuring, reorganization, integration, transfer or
dissolution or any other form of sale of some or all of
our business or operations. We may disclose your personal
information to our corporate affiliates, parents and/or subsidiaries.
We may share and disclose your information with our clients
in connection with our processing of your information on their behalf or to
provide them with our products or services, including to conduct market
research services, respond to your questions and comments, comply with your
requests, market and advertise to you, and otherwise
comply with applicable law.
The Quorum Platform is not intended for use by children under 18 years of age. No one under age 18 may provide any personal information on or through the Quorum Platform. We do not knowingly collect personal information from anyone under 18. If you are under 18, please do not send any information about yourself to us, including your name, address, phone number(s) and email address. In the event that we learn that we have collected personal information from a person under the age of 18, we will delete that information. If you believe that we might have any information from or about a person under the age of 18, please contact us at info@quorumapp.com.
We may update this Policy to reflect changes to our
information practice. We are constantly monitoring developments in law,
introducing new product features and striving to
improve our processes. We encourage you to periodically review this page for
the latest information on our privacy practices.
